LITTLE LAMB STUART LLC – GENERAL LIABILITY WAIVER &

RELEASE AGREEMENT

For Use of All Spaces: Kids’ Play Area, Salt Room, Harmony Room, Workshops and Events

IMPORTANT: THIS IS A LEGALLY BINDING DOCUMENT. READ CAREFULLY BEFORE SIGNING.

By signing this document, you are giving up important legal rights.

1. Parties & Scope

This Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement (“Agreement”) is executed by the undersigned adult participant and/or legal parent or guardian (“Participant”) in favor of Little Lamb Stuart LLC, its owners, members, employees, staff, volunteers, contractors, affiliates, landlords, successors, and assigns (“Released Parties”).

This Agreement applies to any and all activities, programs, use of equipment, products, or services at Little Lamb Stuart LLC, including but not limited to:- Indoor play areas, two-story playhouse, climbing structures, and slides - Lego wall, chalkboard houses, sensory toys, loose items, and interactive wall features

- Salt Room with fine loose Himalayan salt on the ground - Harmony Room and (quiet/relaxation spaces with weighted blankets, low lighting, noise - canceling headphones, and optional non-medical relaxation items) - Workshops, classes, or structured activities- Birthday parties, private rentals, and events - Snacks, drinks, or packaged food items sold on site- Skincare, masks, shampoo, lotions, essential oils (if sold), or any wellness-related products - All furniture, equipment, amenities, décor, and common areas inside or outside the premises

DISCLAIMER: Little Lamb Stuart LLC is NOT a licensed daycare, childcare facility, or medical provider. Nothing provided at Little Lamb Stuart LLC is intended to diagnose, treat, cure, or prevent any medical condition.

2. Acknowledgment of Parental Responsibility

- Little Lamb Stuart LLC is NOT childcare. Parents/guardians must supervise their children at all times unless enrolled in an authorized drop-off session (limited to fewer than 10 children).- If you designate another adult (18+) to supervise, you remain fully responsible for your child’s actions, safety, and behavior.

- You understand and accept that staff supervision, if provided, is general only and does not replace parental responsibility.

3.⁠ ⁠Assumption of All Risks

Participation at Little Lamb Stuart LLC may expose children and adults to inherent and unforeseen risks, including but not limited to:

•⁠ ⁠Slips, trips, or falls on salt, toys, play structures, or common areas

•⁠ ⁠Injuries from climbing, running, jumping, sliding, or rough play

•⁠ ⁠Splinters, scratches, bruises, cuts, sprains, broken bones, or head injuries

•⁠ ⁠Tripping on loose toys, Lego pieces, chalk dust, or other small items

•⁠ ⁠Physical or emotional discomfort from darkened rooms, weighted blankets, or sound- blocking headphones

•⁠ ⁠Reactions or injuries from masks, lotions, or skincare/wellness products

•⁠ ⁠Choking or allergic reactions from snacks, drinks, or other foods

•⁠ ⁠Exposure to communicable diseases (including COVID-19)

•⁠ ⁠Acts, negligence, or omissions of other children, guests, or third parties

I fully accept and assume all risks, known and unknown, even if arising from negligence of Little Lamb Stuart LLC or others, and choose to allow myself and/or my child to participate.

4. Waiver & Complete Release of Liability

To the maximum extent permitted by Florida law, I, on behalf of myself, my child(ren), heirs, representatives, and assigns, hereby:

•⁠ ⁠Release and discharge Little Lamb Stuart LLC and all Released Parties from any and all liability, claims, demands, or causes of action for personal injury, property damage, wrongful death, emotional distress, illness, or any loss that may occur from participation or use of the premises.

•⁠ ⁠Waive any right to sue or bring legal action, including claims based on negligence (ordinary negligence, acts, or omissions).

•⁠ ⁠Agree not to pursue jury trial or damages against Little Lamb Stuart LLC.

•⁠ ⁠Acknowledge this release is intended to be as broad and inclusive as permitted by Florida law.

5. Indemnification

I agree to indemnify, defend, and hold harmless Little Lamb Stuart LLC and all Released Parties from any claims, damages, losses, or expenses (including attorney’s fees) arising from:

•⁠ ⁠My or my child’s participation or use of the premises

•⁠ ⁠Any injury my child causes to another child, adult, or property - My breach of this Agreement

6.⁠ ⁠Emergency Medical Authorization

In case of emergency, I authorize Little Lamb Stuart LLC staff to obtain medical care deemed necessary. I accept full financial responsibility for all medical treatment.

7.⁠ ⁠Food, Allergy & Environment Notice

•⁠ ⁠Little Lamb Stuart LLC is not allergen-free. Food/drinks may contain peanuts, tree nuts, dairy, gluten, soy, or other allergens.

•⁠ ⁠Toys and play structures may contain materials that trigger allergies (wood, paint, dust, salt, etc.).

•⁠ ⁠I assume all risk of allergic reactions or exposures.

8.⁠ ⁠Photo/Video Consent

9.⁠ ⁠SUMMER CAMP PROGRAM ACKNOWLEDGMENT, ASSUMPTION OF RISK, RELEASE, AND PARENT CERTIFICATION (IF APPLICABLE)

This section applies only to participants enrolled in the Little Lamb Summer Camp Program. For all other participants, the remaining provisions of this Agreement remain in full force and effect.

I understand that the Little Lamb Summer Camp Program is operated by Little Lamb Stuart LLC at 870 S Colorado Avenue, Stuart, Florida 34994, and is considered a program, activity, and service offered by Little Lamb Stuart LLC. Participation in Summer Camp shall be fully governed by and incorporated into this General Liability Waiver, Release Agreement, Assumption of Risk Agreement, and Indemnification Agreement.

I acknowledge that Summer Camp activities may occur throughout the facility and may involve the use of:

•⁠ ⁠Indoor play areas

•⁠ ⁠Two-story play structures

•⁠ ⁠Slides and climbing equipment

•⁠ ⁠Salt Room and loose Himalayan salt surfaces

•⁠ ⁠Harmony Room and sensory spaces

•⁠ ⁠Lego walls and building stations

•⁠ ⁠Sensory toys and learning materials

•⁠ ⁠Arts and crafts supplies

•⁠ ⁠Science and STEM materials

•⁠ ⁠Music and movement activities

•⁠ ⁠Educational tools and classroom materials

10. Governing Law & Severability

This Agreement shall be governed by Florida law. If any part is found unenforceable, the remaining terms remain in effect.

11.⁠ ⁠Acknowledgment

By signing, I confirm:

•⁠ ⁠I have read, understood, and voluntarily signed this legally binding waiver.

•⁠ ⁠I understand I am giving up substantial legal rights, including the right to sue for negligence.

•⁠ ⁠I sign on behalf of myself and my minor child(ren) with full authority to do so.

⚠ IMPORTANT FINAL ACKNOWLEDGMENT

By signing below, I confirm I have initialed each section above and understand I am waiving substantial legal rights, including my right to sue Little Lamb Stuart LLC, its owners, or staff for any injury or loss, even if caused by negligence.
